5 April 2019, the Government proposed changes to the whistle-blowing provisions in the Working Environment Act.
The main intention of the proposal is to codify current law to make the rules more accessible for people in general. For instance, the Government has proposed provisions clarifying what is considered to be "censurable conditions" at the employer's undertaking, "retaliation" against an employee and how the employee can "proceed responsibly" when making such notification. The proposal also includes regulations of the employers' obligation to act after being notified, for example by treating the notication within a "reasonable time".
The proposal's largest change is an extention of the whistle-blowing regulations to include persons that are not regarded employees who perform work in undertakings, see Working Environment Act Section 1-6. The proposal implies that the whistle-blowing regulations will apply to students, national servicemen, patients, etc, but not inmates.
The Government also proposes to introduce strict liability for financial loss occuring after retaliation.
